The measure referred to in the introduction to define the concept of medicines in accordance with European regulation is as essential to emphasize the dual role :

  • Purpose of the drug, independent of an actual effect (by virtue of their designation, presentation drugs)
  • Existence of pharmacological, immunological or metabolic effect in the treated human or animal organism (by virtue of their function, functional medicine).

This means that there are both items that are for the purpose of treating or prophylaxis used, or intended to be used (even when should they act in fact not healing or disease prevention) classified as medicines, like products that bring the no claim to salvation, but because of their special composition of an enhancer. This classification is important because drugs are covered by another law as food, cosmetics or medical devices (the problem of product differentiation).

Medicines Act

Drugs, short herbs or equivalent drugs (Latin medicalmentum – the remedy) is any substance or combination of substances which are presented as having properties for treating or preventing human or animal diseases or used in or on the human or animal body or a person or . animal can be administered to either restore the human or animal physiological functions by exerting a pharmacological, immunological or metabolic action to correct or correcting or making a medical diagnosis. “This somewhat unwieldy description is based on the definitions in the two basic statutory regulations on the human and veterinary products in the European Union Directives 2001/83/EC. (Community Code on human medicines) and 2001/82/EC . (Community Code of veterinary drugs) in the current version. It is now incorporated in many national drug laws, including German and in the Medicines Act. Treatment with drugs known as medication.
